How the Land Titles Office deals with the land will depend on how the deceased held the property; for instance whether they were Sole Owner, Joint Tenants, Tenants in Common or Trustee. The majority of couples hold land as Joint Tenants making the transfer of the property quite seamless after the correct Applications to Register Death are lodged. In other circumstances however the process can be slightly more involved with a number of other forms and documents required.
